By accessing and using one of our websites you explicitly agree to the following terms and conditions.

The laboratory makes great efforts to ensure that the information provided is complete, correct, accurate and updated. Despite these efforts, inaccuracies may occur in the information provided. This website is governed by Dutch law and the Dutch courts have exclusive jurisdiction to hear any dispute that may arise in connection with these websites.

Processing purposes
The laboratory collects and processes the personal data of customers for customer and order management (including customer administration, following up orders / deliveries, invoicing, monitoring solvency, profiling and sending marketing and personalized advertising).

Legal basis (s) of processing
Personal data is processed based on; 1) consent, 2) necessary for the implementation of an agreement, 3) necessary for compliance with a legal obligation, 4) necessary for the promotion of our legitimate interest in doing business, of the General Data Protection Regulation.
Insofar as the processing of personal data takes place on the basis of consent, the customer always has the right to withdraw the consent given.

Transfer to third parties
If this is necessary to achieve the stated objectives, the personal data of the customer will be shared with other companies that are directly or indirectly connected with the laboratory or with any other partner of the laboratory.
The laboratory guarantees that these recipients will take the necessary technical and organizational measures to protect the personal data.

Retention period
ELN/WHL keeps your data for the period that is necessary to meet the legal requirements (including in the field of accounting). and is necessary for the purposes for which your data is processed.

Right of access, improvement, erasure, restriction, objection and transferability of personal data
The customer has the right to inspect his personal data at all times and can correct them or have them corrected if they are incorrect or incomplete, have them removed, have their processing limited and object to the processing of personal data concerning him based on article 6.1 (e) or (f), including profiling based on those provisions.
In addition, the customer has the right to obtain a copy (in a structured, common and machine-readable form) of his personal data and to have the personal data forwarded to another company.

1.6 The use of "cookies"
"Cookies" may be placed on the hard drive of your computer during a visit to our sites. A cookie is a text file that is placed by the server of a website in the browser of your computer or on your mobile device when you consult a website. Cookies cannot be used to identify people, a cookie can only identify a machine.
What type of cookies are used and for what:

2. General conditions applicable to the laboratory

2.1 Scope
These conditions apply to all services of World Health Laboratory (ELN/WHL), the address of which is the registered office on the front, and which is always referred to below as the "the laboratory". Deviations from, exceptions to and additions to these conditions only apply if they have been accepted by the laboratory in writing.

2.2 Accreditation
ELN / WHL is accredited for a large number of analyzes by CAP (College of American Pathologists, http://www.cap.org). A detailed list of analyzes that fall under external accreditation is available in the laboratory. The quality system includes the pre and post analytical phase and the analytical phase itself.

2.3 Offers
Offers and quotations are always without obligation and only valid for a period of 30 days, unless agreed otherwise in writing.

2.4 Applications
Requests for analyzes must be provided with a specific request form from the laboratory (on paper and / or digitally) or in another written and clear manner. The laboratory accepts oral additions to existing applications and records this in writing. The laboratory has the authority not to accept a request and in that case undertakes to inform the client immediately.

2.5 Liability
The laboratory undertakes to perform the work in accordance with generally recommended clinical standards, but does not guarantee the achievement of any results. The analysis results displayed must always be accurately interpreted with the requisite medical expertise of the applicant or another medical expert requested for this purpose. In case of doubt about the analysis results, the laboratory should first be contacted about this for further explanation. Any liability of the laboratory for damage of whatever nature suffered by the client or third parties is expressly excluded, unless there is a demonstrable or gross error, in which case the laboratory's liability is limited to EUR 25,000.00 per claim.

2.6 Confidentiality
The laboratory is obliged to comply with the legislation concerning the protection of privacy except in the case of a different legal obligation or court order. The laboratory does, however, have the right to use results for comparison, reference, statistical or scientific purposes, whereby the aforementioned legislation remains fully applicable.

2.7 Samples, transport and storage
The client supplies samples for research according to the guidelines of the laboratory. If so agreed, the laboratory is responsible for transporting samples according to the rules of the art, but is not liable for loss or damage, neither during transport nor at the laboratory itself. The laboratory stores the samples according to standard guidelines, unless otherwise agreed in writing.

2.8 Implementation
The laboratory determines the manner in which, the method and the equipment with which the laboratory's activities are carried out. Information about this is available for clients.

2.9 Results
The laboratory directs the results exclusively to the client, unless there is a different assignment in writing. The report may only be reproduced in its entirety by the client, unless after written permission from the laboratory.

2.10 Prices
The laboratory invoices analyzes according to a standard price list, unless otherwise agreed in writing by the laboratory.

2.11 Payments
Each invoice is considered to be definitively accepted by the client unless it sends a reasoned protest by registered letter within 21 days of the invoice date. Invoices are payable within 14 days after the invoice date. After the payment term has expired, the laboratory is entitled to interest at the statutory interest rate but at least at 1% for each month or part thereof, without a reminder being required. In the absence of immediate payment, the file can be transferred to a specialized third party who is accredited to carry out the amicable collection activity. This person will be mandated to collect the amount due, plus a lump sum compensation on the amount due, without prejudice to the right to prove the actual damage suffered if it is greater.

2.12 Complaints
The laboratory commits itself to carefully handle complaints from clients about any aspect of the medical-analytical services.

2.13 Other languages
With interpretation differences in translations of text, the Dutch version prevails.

2.14 Applicable law, disputes
These conditions are subject to Dutch law; for the settlement of disputes, only the court in Utrecht has jurisdiction.
